1. Definitions

  • “STONESHUB,” “we,” “us,” “our”: Stoneshub, Division of Canada Infrastructure & Overseas Inc.
  • “Buyer,” “you”: the purchaser.
  • “Goods”: natural stone products and related items sold through the Site.
  • “Seller / Supplier”: STONESHUB and/or third-party suppliers/importers/warehouses who may fulfill orders.

2. Marketplace Model (Important)

STONESHUB operates as a marketplace and sourcing platform. Some orders are fulfilled by STONESHUB; others may be fulfilled directly from a third-party supplier/warehouse. Regardless of fulfillment source, these Terms apply unless a written exception is provided.

  3. Product Representation & Natural Stone Variation

Natural stone varies by nature. Color, shade, veining, pits, fissures, mineral marks, thickness and texture variations are normal and not considered defects.
Photos/samples are representative only. Exact match is not guaranteed.

Installed, cut, sealed, or altered material is deemed accepted and is not eligible for return or refund.

 4. Order Acceptance

Your order is not accepted until we:

  • confirm payment authorization, and
  • issue an Order Confirmation or release the order for shipment/pickup.

We may cancel/refuse orders due to pricing errors, stock errors, address issues, suspected fraud, or shipping limitations. If cancelled after payment, we will refund amounts actually received (subject to any non-refundable special order charges disclosed at checkout).

  5. Pricing, Currency, Taxes, Duties

  • All prices are in USD unless stated otherwise.
  • Taxes may apply based on shipping destination and applicable law.
  • Duties, brokerage, customs, and import charges (if applicable) are the Buyer’s responsibility unless explicitly included at checkout.
  • Shipping fees are estimates based on the information you provide; final charges may change if access conditions differ (e.g., liftgate needed, remote delivery, appointment delivery, construction site restrictions).

6. Payment

Payment is due in full at checkout, unless a written credit arrangement exists. We use third-party processors (e.g., card processors, payment gateways). STONESHUB does not store full payment card data on its servers.

 7. Packaging

Goods are shipped using standard industry packaging (pallets/crates/boxes). Minor edge chipping can occur during freight handling and is not automatically considered a defect unless beyond reasonable industry tolerance and verified under the claims process below.

 8. Delivery Method, Access & Unloading

Unless otherwise stated, deliveries are curbside/driveway at ground level. Carriers typically do not:

  • bring items inside, upstairs, or into specific rooms,
  • unpack crates/pallets,
  • remove debris,
  • provide liftgate service unless purchased.

You must provide accurate delivery details and ensure safe access for a freight truck. Any additional charges (waiting time, re-delivery, storage, address correction, liftgate, limited access, appointment requirements) are billed to the Buyer.

 9. Delivery Timelines

Delivery dates are estimates. Delays may occur due to carriers, weather, customs, supply chain, production, or events beyond our control. We are not responsible for indirect losses (labour standby, project delays, penalties, etc.).

  10. Risk of Loss & Title

  • Title passes when Goods are released for pickup or handed to the carrier (unless mandatory law says otherwise).
  • Risk of loss/damage transfers to Buyer once Goods are handed to the carrier, subject to the damage/claims procedure below.

11. Inspection, Damage, Shortage & Claims (Strict Procedure)

Inspect BEFORE signing the delivery receipt.

  1. A) Visible Damage (packaging or stone):
  1. Take photos (all sides + labels)
  2. Note clearly on the carrier paperwork: “DAMAGED—SUBJECT TO INSPECTION”
  3. Notify STONESHUB within 24 hours of delivery
  1. B) Concealed Damage: report within 72 hours with photos and keep all packaging.
  2. C) Shortage / Wrong Item: report within 72 hours.

Failure to follow these steps may void freight claims and may result in the order being treated as accepted.

 12. Returns & Exchanges

Because stone is lot-based and freight is high, returns are limited.

Return-eligible (only with prior written approval):

  • Unused, uncut, uninstalled goods
  • In original packaging and resalable condition
  • Return request within 7 days of delivery
  • Buyer pays return freight + restocking fee (typically 25%) unless otherwise stated

Non-returnable:

  • custom/special orders, fabricated items
  • clearance / “final sale” items
  • installed/cut/sealed/altered goods
  • goods without original packaging or damaged after delivery

13. Cancellations

Orders can be cancelled only before picking/packing, allocation, or production begins. If cancellation is possible, a fee may apply to cover supplier/processing/shipping costs already incurred.

 14. Quantity / Overage

Buyer is responsible for ordering sufficient material. Typical overage is 10%–15%, more for patterns/diagonal layouts and future repairs. Matching lots later is not guaranteed.

 15. Limited Express Warranty

Our only express warranty is that the delivered Goods substantially match the order confirmation description, subject to natural stone variation.

 16. Disclaimer of Implied Warranties

To the maximum extent permitted by law, Goods are provided “AS IS” without implied warranties of merchantability, durability, fitness for a particular purpose, or non-infringement. Some jurisdictions limit exclusions; where those apply, exclusions are limited accordingly.

 17. Limitation of Liability

To the maximum extent permitted by law:

  • No liability for indirect, incidental, special, consequential, or punitive damages.
  • Total liability for any claim will not exceed the amount paid for the specific Goods giving rise to the claim.

18. Force Majeure

We are not responsible for delays or failures caused by events beyond reasonable control, including supply disruptions, port/customs delays, carrier failures, weather events, strikes, or acts of government.

 19. Governing Law & Venue

These Terms are governed by the laws of British Columbia, Canada and applicable federal laws of Canada. Any disputes will be brought in courts located in British Columbia, except where consumer protection laws in your jurisdiction require otherwise.
